Terms and Conditions
These terms and conditions govern the provision of swimming pool and spa safety barrier inspection services by PCV Pty Ltd trading as Pool Compliance Victoria (ABN 95 609 595 338, ACN 639 224 810), located at 37 Cliff Road, Frankston VIC 3199 ("we", "us", "our").
1. Scope of Services
We provide building inspection services specifically relating to swimming pool and spa safety barriers in the State of Victoria, under the provisions of the Building Act 1993 and the Building Regulations 2018. Our services include initial barrier compliance inspections, periodic 4-year renewal inspections, follow-up re-inspections, and pre-inspection advisory consultations.
2. Standards and Regulatory Framework
Inspections are conducted strictly in accordance with the applicable Australian Standard (AS 1926.1-1986, AS 1926.1-1993, or AS 1926.1-2012) determined by your municipal council based on your pool or spa installation date. Verbal advice given during consultations does not replace formal statutory certification.
3. Booking, Payment and Fees
Inspection fees must be paid in full prior to or upon completion of the on-site inspection, before any statutory Certificate of Barrier Compliance (Form 23) can be issued. Invoices must be settled in cleared funds. Payments made via credit card may be subject to standard merchant processing surcharges.
4. Property Access & Safety
The client must ensure clear, unrestricted, and safe access to the pool enclosure and barrier perimeter on the agreed inspection date. All pets and unrestrained animals must be secured during the inspection. If access is obstructed, a rescheduling fee may apply.
5. Postponement and Cancellation Policy
Cancellations or postponement requests must be notified at least 24 hours prior to the scheduled appointment time. Cancellations made with less than 24 hours notice or unattended sites may incur an administrative call-out fee.
6. Statutory Notices & Re-Inspections
Where non-compliant items are identified, we issue an Owner Notice under the Building Regulations allowing up to 60 days for rectification. A physical on-site re-inspection must occur before a certificate can be issued. Photographic evidence cannot be accepted under Victorian legislation. Failure to rectify within the statutory window requires notification to council.
7. Photography & On-Site Records
Our inspectors photograph safety barriers, gates, latches, and non-climbable zones during inspection for audit and statutory reporting records. These images form part of our confidential compliance file.
8. Privacy
Personal information collected during booking and inspection is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).
9. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Victoria, Australia.
