4 Ways Your Pool Fence May No Longer Be Compliant

Even if your swimming pool safety barrier was certified compliant when it was originally installed, outdoor exposure, soil movement, and garden growth can easily cause it to fall out of compliance over time.

As registered building inspectors who conduct hundreds of pool compliance inspections across Victoria each year, we see the same recurring issues. Here are four common reasons why an existing pool barrier may no longer pass inspection:

1. Gate Fails to Self-Close and Self-Latch

Under all Victorian standards, a pool gate must be self-closing and self-latching from any position—including when opened just a fraction of an inch. Over time, spring hinges lose tension, gate posts sag due to soil expansion, or latch mechanisms wear down. If a gate rests against the latch without clicking shut securely, it is immediately non-compliant.

2. Ground Level Changes Under the Barrier

The gap between the bottom of your pool barrier and finished ground level must never exceed 100 mm. Adding garden mulch, topsoil, or pavers can inadvertently raise the ground level and reduce the overall 1.2 m height requirement. Conversely, pets digging or soil erosion under a fence can create gaps larger than 100 mm, allowing a toddler to crawl underneath.

3. Vegetation and Objects in the Non-Climbable Zone

The Australian Standard mandates a 900 mm Non-Climbable Zone (NCZ) on the outside face of the barrier. It is very common for garden trees, hedges, and vines to grow into this quadrant. Additionally, potted plants, pool pumps, outdoor furniture, or storage boxes placed near the barrier create climbable footholds that violate safety regulations.

4. Boundary Fence Deterioration

Where a boundary fence forms part of your pool safety barrier, it must maintain a height of at least 1.8 metres on the inside. Warped paling fences, loose palings, or neighbour additions on the other side of the fence (such as garden trellises or retaining steps) can breach the barrier's integrity.
